10 If data are to be received from a non-State actor with which WHO has an existing agreement (such as a Memorandum of Understanding, Data-sharing agreement or Letter of Agreement), the terms under which the data will be licensed to WHO and how the data can be reused, modified and republished should be checked. It must be stipulated that the data will be anonymized (see section XXII.3.2). If no such agreement exists, consideration should be given to establishing a Data-sharing agreement or Letter of Agreement, in consultation with the Office of the Legal Counsel (LEG).
20 If data are accessed through a commercial database, the terms under which the data will be licensed to WHO and how the data can be reused, modified and republished should be checked before the data are ingested into WHO's systems. LEG should be consulted in the event of any concerns.
