10    An appointment normally comes to an end effective on the dates specified in Staff Rule 1090. There are the following exceptions:

  1. in case of death, date of separation is the date of death;
  2. for completion of appointment, the effective date is the last day of the contract. Separation at an earlier date would require notice and may require indemnity;
  3. if an appointment is terminated while the staff member is in leave status, the effective date is that indicated in the official notice;
  4. if on the effective date of separation, a staff member is determined by the Staff Physician, SHW/Regional Staff Physician, further to paragraph 20 below, to be fully incapable of performing current duties, due to an unplanned medical condition likely to warrant emergency, continuous or frequent medical treatment, or to be of long duration (hereinafter referred to as “serious medical condition"), subject to paragraphs 30-50 below, the appointment may exceptionally be extended for the period of duration of the full working incapacity due to the serious medical conditions up to the maximum of the staff member's entitlement to sick leave under Staff Rule 740.1.1 and, if applicable, of any sick leave under insurance cover under Staff Rule  750.1;
  5. if a staff member works  up to and inclusive of the last working day of a month ending with a weekend or an official holiday, the effective date of separation is the end of the month, unless the travel time continues beyond the end of the month.

Deferral of the effective date of separation due to serious medical condition

20   The Staff Physician,​ SHW/Regional Staff Physician will assess the medical condition based on medical evidence, comprising at least the latest/required medical certificate and the medical report, that is presented by the staff member during the period of appointment. The Staff Physician, SHW/Regional Staff Physician may require any additional information considered necessary to provide informed advice and may request the staff member to undergo a medical examination in accordance with Staff Rule 1085.

30  On the basis of the advice by the Staff Physician, SHW/Regional Staff Physician, and subject to the provisions set out in paragraph 50 below, an exceptional extension of the appointment and deferral of the effective date of separation for the recommended period may be approved by the Director HRT/Regional Director Administration and Finance (DAF).

​40 The Director HRT/DAF will inform the staff member in writing of the deferral of the effective date of separation and an exceptional extension of appointment and record the staff member's sick leave in the system.  Copies of correspondence shall be forwarded to Director HRT for monitoring purposes.

 ​​50 The exceptional extension of appointment due to serious medical condition does not apply to separation from service under the following Staff Rules:

  1. Resignation under Staff Rule 1010:
  2. Separation by mutual agreement under Staff Rule 1015;
  3. Retirement under Staff Rule 1020
  4. Termination for reasons of health under Staff Rule 1030
  5. Non-confirmation of appointment under Staff Rule 1060
  6. Unsatisfactory performance or unsuitability for international service under Staff Rules 1070 and 1045.1.2
  7. Refusal of reassignment under Staff Rule 1072
  8. Misconduct under Staff Rule 1075; and
  9. Abandonment of post under Staff Rule 1080​.
