10 Separation following non-confirmation of appointment applies to a fixed-term staff member on probation whose performance in the position to which they are appointed, or whose adjustment to employment in the Organization in general has not been satisfactory and for whom further probation in another position is not possible. The conditions of such non-confirmation of a probationary fixed-term appointment are specified in Staff Rule 1060.
20 In cases which could lead to the non-confirmation of a probationary fixed-term appointment for the reasons set out in Staff Rule 1060, the supervisor must discuss in good time with the staff member on their shortcomings, those discussions must be documented. These documented discussions can be in addition to the requirement in Staff Rule 540 that a performance evaluation report, in this case, a "Probationary Performance Appraisal Report", be made, although they cannot replace it. Supervisors are advised to refer to Staff Rule 530 and III.5, Performance and Change of Status, III.5.3 Performance Appraisal.
30 The confirmation of appointment decision is taken by the Director-General for all staff members at grade P.6/D.1 and above as well as WHO Representatives; the Assistant Director-General concerned for staff members at Headquarters at grade P.5 and below; the Regional Director for all regional staff members up to and including grade P.6/D.1, except for WHO Representatives. The final decision concerning the probationary staff member's fixed-term appointment status is taken on the basis of the Probationary Performance Appraisal Report, and the staff member's comments thereupon, if any. The report must be shown to the staff member who must be informed no later than one month before the date on which the probationary period expires that it is proposed not to confirm the appointment further to Staff Rule 540.1.3.
40 The probationary period may be extended by one or two months, as provided for in Staff Rule 540.1.2 as an interim measure if there is likely to be a delay and if it is necessary for a fair and thorough review of the case to be made before a decision is taken.
50 Action not to confirm a probationary fixed-term appointment is not taken until it is clear that extended probation (Staff Rule 540.1.2) or reassignment is not feasible. However, supervisors should not interpret this requirement as grounds for continuing employment beyond the date on which it is clear that a staff member's appointment will not be confirmed. Such action is not in the interest of either the staff member or of the Organization.
60 If the staff member's probationary fixed-term appointment is not confirmed, the staff member must be so notified. Staff Rule 1060 sets the period of notice for separation for non-confirmation of a probationary fixed-term appointment at one month. No indemnity for non-confirmation of fixed-term appointment is payable. Upon receipt of all documentation and approvals related to the non-confirmation of a probationary fixed-term appointment, the HR Administrator, GHR will process the appropriate administrative action.
70 According to Staff Rule 1225, a staff member may request an Administrative Review of a decision taken under Staff Rule 1060 not to confirm their appointment. The Administrative Review must be requested within 60 calendar days of receipt of notice of non-confirmation, on the grounds of unsatisfactory performance or conduct, or because of unsuitability for international service, if they consider that such decision has been made for reasons not connected with their performance, conduct or suitability for international service.
